This document is a good-faith DIY draft intended for beta-launch conditions. It is not a substitute for legal counsel. For commercial deployment or complex cases, consult a qualified lawyer specialized in IT and IP law.
By creating an account or using any part of the Mythoscan service (the “Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
Mythoscan is a Software-as-a-Service platform that performs automated security and compliance audits on domains you submit. The Service runs in two tiers:
You must be at least 18 years old and legally capable of entering into a binding contract in your jurisdiction. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately of any unauthorized use.
You may only submit domains for which you are the legitimate owner or for which you have received explicit written authorization (for example, through a maintenance contract, a mandate letter, or a pentest agreement). You are solely responsible for ensuring the legality of every scan you run.
Scanning domains without authorization may constitute a criminal offense under French law (Articles 323-1 et seq. of the French Criminal Code) and equivalent legislation in other jurisdictions. Mythoscan cooperates with judicial authorities in case of complaint and reserves the right to suspend or terminate any account suspected of unauthorized use, without notice or refund.
We offer a free tier, a 14-day trial without credit card on paid plans, and paid monthly or annual subscriptions. All prices are displayed in euros, VAT excluded unless stated otherwise. Payments are processed by Stripe Payments Europe Ltd. and are subject to Stripe's terms.
You may cancel at any time from the customer portal. Cancellation stops the next billing cycle. No pro-rata refund is granted for partial months already paid, except where French consumer law requires otherwise.
Use of the Service is governed by our Acceptable Use Policy, which forms an integral part of these Terms. You agree not to use the Service to harass, harm, or disrupt any third party, nor to circumvent its technical limitations.
Your personal data is processed in accordance with our Privacy Policy. All customer data is hosted in the European Union (France, Paris region, eu-west-3). You retain full ownership of the scan results generated on your behalf.
The Service, including its source code, design, brand, and documentation, is the exclusive property of Mythoscan. You are granted a non-exclusive, non-transferable, revocable license to use the Service for the duration of your subscription.
Scan reports generated for your domains belong to you. You may re-brand, re-sell, and redistribute them to your clients without attribution to Mythoscan (white-label usage is expressly permitted on paid plans).
The Service is provided “as is” and “as available”. Mythoscan makes no warranty that the Service will be uninterrupted, error-free, or that it will detect every vulnerability. Security is a process, not a product: a clean report does not guarantee that your system is secure.
To the maximum extent permitted by law, Mythoscan's total liability under these Terms is capped at the total amount you paid to us in the twelve months preceding the event giving rise to the claim. We are not liable for indirect, consequential, or punitive damages, including loss of data, loss of profit, or business interruption.
We may suspend or terminate your account at any time, with or without notice, in particular if you breach these Terms, the Acceptable Use Policy, or applicable law. Upon termination, your access ends immediately and your data may be deleted after 30 days unless you request an export.
These Terms are governed by French law. Any dispute that cannot be resolved amicably shall be submitted to the competent courts of Paris, France, unless mandatory consumer-protection rules apply.
